The custody dispute between Halle Berry and Olivier Martinez has taken a new turn after Martinez filed for a temporary restraining order involving their 12 year old son.
Martinez alleges that Berry physically confronted their son at her home on Sept. 26. He is also asking the court to change their current custody arrangement and give him sole custody.
Berry’s attorney, Marina Beck, has rejected Martinez’s account. Her response points to previous court rulings and claims that Martinez has violated court orders and interfered with services for their son.
The competing claims have now placed the former couple back in court over the care and custody of their child.
What Halle Berry’s ex is asking the court to do
According to Martinez’s filing, the alleged incident happened while their son was staying with Berry. Martinez says Berry placed her hands around the boy’s neck and choked him.
He also claims there have been other incidents involving physical, verbal and emotional conduct toward their son.
Martinez is seeking sole custody as part of his request. He also asked the court to impose conditions on Berry’s visitation, including a restriction involving alcohol or other substances.
The court did not grant every request in the initial order. Berry must stay 100 yards away from Martinez, but she can still have unsupervised visits with their son.
Halle Berry’s response
Berry’s attorney strongly disputes Martinez’s version of events. Beck says court records contain evidence of previous disputes involving Martinez and claims that he has already faced legal sanctions for violating court orders.
She also points to what she describes as Martinez’s history of aggressive behavior. The statement appears to reference the 2012 confrontation between Martinez and Gabriel Aubry, who was dating Berry at the time.
That incident happened during a custody dispute involving Aubry’s daughter with Berry. Aubry accused Martinez of attacking him. Martinez’s side disputed that account and said Aubry started the confrontation. The 2012 dispute is separate from the current custody case involving Berry and Martinez’s son.
Where the custody case stands
Berry and Martinez married in 2013 and separated in 2015. Their divorce was finalized in 2023. The former couple currently share custody of their son.
The latest filing has brought their private family dispute back into court. Martinez wants the existing arrangement changed. Berry’s legal team is challenging the allegations and defending her role as a parent.
For now, the court’s initial order allows Berry to continue unsupervised visitation with her son while the broader dispute moves forward. The latest filings contain allegations from Martinez and responses from Berry’s attorney. Those claims have not been established as final findings of fact by the court.
