Buc-ee’s has settled its trademark lawsuit against Ohio convenience store chain Mickey’s after months of legal arguments over their animal mascots. The companies reached a confidential agreement during a federal settlement conference on Sept. 15.
The settlement closes a case that began in February, when Buc-ee’s sued Coles IP Holdings, the company behind the Mickey’s chain, in the U.S. District Court for the Northern District of Ohio. The Texas travel center company argued that Mickey’s moose logo was too similar to its well-known beaver branding.
The settlement terms have not been made public. It is also unclear whether Mickey’s will change its logo, signage or other branding as part of the agreement. Court records confirm the case was set for a settlement conference before the agreement was reached.
Buc-ee’s challenged the Mickey’s branding
The lawsuit focused on the visual similarities between the two companies. Buc-ee’s argued that Mickey’s use of a smiling cartoon moose, along with red branding, could create confusion with Buc-ee’s registered marks.
The complaint also sought relief under federal trademark law and challenged Mickey’s existing trademark registrations. Buc-ee’s had already taken action against the Mickey Mart trademarks before filing the federal lawsuit.
Mickey’s, meanwhile, filed a counterclaim after the initial complaint. The Ohio chain disputed Buc-ee’s position and maintained its own claims in the case.
The dispute arrived as Buc-ee’s expanded its presence in Ohio. The company opened its first Ohio location in Huber Heights in April, giving the Texas-based chain a new foothold in the state.
The settlement leaves key details private
For now, the biggest unanswered question is what happens to the Mickey’s branding.
Neither the settlement terms nor any required changes to the moose logo have been publicly disclosed. That means the agreement cannot yet be used to determine whether either side made changes to its branding strategy.
The case is also part of a broader trademark push by Buc-ee’s. In July, the company filed another Ohio lawsuit against Beaver’s Mini Mart in Beavercreek over branding that includes a beaver mascot.
Buc-ee’s has also pursued trademark disputes involving other retailers with animal-themed branding in recent years.
The Mickey’s settlement now brings one of those Ohio cases to a close. What remains unclear is whether the confidential agreement will change the look of Mickey’s stores or simply end the legal dispute between the two companies.
